Clearly it makes sense to bunk up in Chalets to reduce costs as we normally do, so worth talking to other teams or offering space if you have booked.

Can I change the name on my entry ?

Each entry must have a Team Captain, ideally enter your whole team together. You can add extra members to your team but if you want to change team members or Team Captain please ask your Team Captain to let us know by contacting info@bangerrallychallenge.org 

Please be aware that we cannot process refunds to change team members. Please sort this out between yourselves.

Terms and Conditions

  1. Refunds

In the event that the event does not run for any reason, you are entitled to a refund of all monies paid less a £10 admin charge per person.

  1. Liabilities

You enter the event entirely at your own risk. The Banger Rally Challenge are simply providing you with a route and referral to accommodation. We will not accept any liability for any damage, accident or incident during the rally. The minimum age for any team captain or driver on the event is 21 years and the minimum age for any team member is 14. You will take responsibility for your personal safety and legal compliance. We will not ask you if your car is taxed and insured. There will be a bar on site, there will be beer drenched after party, and a band, but we will not monitor how much you drink or if you are legal to drive in the morning. If you get arrested or your car is confiscated, which is always a laugh (for the rest of us ) we will, of course, assist where we can but you should have read the local rules. We will be setting challenges along the way. If you feel that a challenge is hazardous, don’t do it; none of them are compulsory. Some may involve eating a local delicacy (no one who was there can forget the mustard challenge in Dijon), but we won’t be giving allergen advice. Lastly, if you break you pay for it. Damages to property or fines for leaving a chalet dirty are your responsibility, not ours and you will have to pay them before you leave the campsite.

  1. Behaviour

Please bear in mind we will be running this event next year too and we hope to return to Tencreek. Whether or not we are welcome rests entirely on how we behave. By all means, drink, sing dance and get up to high jinks but do not damage property, vehicles or start a roaring contest at 3am. Be respectful of other guests onsite. Drive legally and safely. It is illegal to road race anywhere in the UK.

  1. Respect

By all means, have fun. Stick stickers on other people's cars, cling film them, spray them with water pistols, but don’t deface or disable another entrant’s’s car and so end their event. And do respect the enormous time and effort that has been put into their vehicles. Please treat your Team Leader with respect, they can normally be bribed with beer. However their decisions on marking your challenges are final.

  1. Charity

You will be offered a charity donation option on sign up but we encourage you to use this event as a fund raiser and we will ask you at check-in at the start how much you have raised and for which charity. Please do some fundraising; just raising £100 per car between now and May will mean this event will raise £10,000. We can help set up your JustGiving page and promote it for you. We will be posting ideas on how to do this on the website and Facebook.

  1. Rights Reserved

The Banger Rally Challenge reserves the right to give a final decision on any breach of the rules of the event, or our terms and conditions. They also reserve the right to require your team to leave the event for serious breach of same. Likewise the decisions of points awarded by Team Leaders is final. The Prizes and Trophies awarded by the Rally Team are also a final decision. Please remember it is all just for fun.

Terms/Conditions & Definitions

“Event” means the specialist Charity Car Rallies organised by the Organiser/s (Banger Rally Challenge) as set out in clause 1.

“Website” means the website of the Organiser/s at www.bangerrallychallenge.org.

“Organiser/s” means ‘Cornwall Banger Rally Challenge of Mortgage Works Ltd, East Hill ST Austell, Cornwall PL25 4TR

“Participant” means any person participating in the event as a driver or passenger.

“Participating Team” means a team of Participants participating as a team in one car in the event.

“Registration Form” means the registration form on the Website to be completed by a Participant or Participating Team when signing up for Cornball 2024.

“Full Payment” means the total amount payable by a Participant or a Participating Team to the Organiser for participating in the Rally.

  1. Event

1.1 The Organiser/s traditionally promotes specialist charity car banger rallies for cars preferably over 15 years of age (58 reg or earlier) however there is no restriction on your vehicle for this event, other than it being road-legal.

1.2 The cost of repairs, modifications and/or enhancements and road worthiness is at the discretion of the Participant or Participating Team. Cornwall Banger Rally Challenge, accepts no responsibility for any repairs, modifications/enhancements, road worthiness, Speeding/parking or ANY driving/traffic violation.

1.3 The Rally is a tour and NOT a race, and there is NO competition to any driving element of the banger rally challenge.

1.4 Participants and Participating Teams will ensure that they’re aware of, and comply with ALL applicable laws, rules and regulations of driving in Cornwall. Participants and Participating Teams must drive safely and with courtesy to all other Participants in the Rally and to members of the Public.

1.5 The Organiser/s will set challenges & quizzes for the Participants and Participating Teams to be completed during the course of the event. You do not have to accept any of the challenges presented.

1.6 All Rules as published on the Rules page of the website must be obeyed and failure to do so may result in Participating Teams being disqualified. Border incursion into Devon, howsoever caused, will also lead to disqualification.

  1. Vehicles

 

2.1 The vehicle must be road legal and have a valid MOT/TAX (or equivalent if the vehicle is not a UK registered vehicle) and Insurance to cover the duration of the event.

2.2 Any modifications must not compromise the safety or legality of the vehicle. It is recommended these should be declared with insurers otherwise policies may be void.

2.3 If the Organiser/s believes that the vehicle is illegal and/or unsafe, entry into the event may be refused and a refund will not be issued.

  1. Eligibility

3.1 ALL drivers must be over 21 years of age and all team members must be over 14 years of age on launch day of Cornball 24.

3.2 Any holder of a valid driver’s licence recognised by the countries on the UK and whose licence is valid for the entire duration of the event shall be eligible to participate.

3.3 Driver’s licenses of all persons intending to drive in a Participating Team shall be inspected prior to commencement of the event by the team captain.

3.4 Non driving passengers are eligible to enter, providing at least one members of their Participating Team hold a valid driving licence as set out in clause 3.2 above.

3.5 The Organiser/s recommends the purchase of  break down cover for the duration of the event.

3.7 The Organiser/s reserves the right to cancel a booking at any time if these eligibility conditions are not met.

  1. Registration

4.1 A Participant team will complete and submit a Registration Form, including the names of all members of the Participating Team, including vehicle details and any other charity beneficiaries personally chosen on the website when signing up. We will ask the amount raised upon launch day. If you do not have your own charity, we will have a just giving page on our website (bangerrallychallenge.org) for our Cornball 24 nominated charities.

4.2 The Participant or a member of the Participating Team, on behalf of all other members, in completing the registration process confirms that they have read, fully understand and accept these terms and conditions.

4.3 Each member of the Participating Team is jointly and severally liable for the actions of the Team.

4.4 Upon completing/completion of the registration process, payment of the entry and accepting the Terms and Conditions, a binding contract is created between the Participant or Participating Team and the Organiser/s.

4.5 One Participant (Team Captain) of the Participating Team should be authorised by the other Participants of that team, including any substituted Participants, to accept these terms and conditions on their behalf. The Organiser/s shall bear no responsibility to communicate with each Participant of a Participating Team separately. We will communicate solely with the team captain/participant of each team during the signing up/registration process.

4.6 The name of the Participant or the Participating Team may appear on the Website (bangerrallychallenge.org) shortly before or after the Departure Date (11th May 2024) of the event.

4.7 The Organiser/s reserves the right to reject any Registration Form at its sole discretion.

  1. Payment

5.1 Full Payment will be paid by the Participating Team on registration/sign up.

  1. Cancellation

6.1 All cancellations must be submitted by the same Participant/Team Captain, agreeing to these terms and conditions.

6.2 The date of cancellation will be recorded as the date when written/email confirmation is received by the Organiser/s.

6.3 All cancellations will be subject to deductions as set out in clauses 6.4 and 6.5 below.

6.4 Participant or Participating Team Cancelation:

6.4.1 More than 60 days before date of departure 11th May 2024; All money paid is fully refundable less the deposit plus an additional £10 per person administration fee

6.4.2 Within 30 days of departure; No refunds possible.

6.5 In the event of unforeseen circumstances which force the Organiser/s to cancel the event, a full refund shall be made to all Participants and Participating Teams less an administration cost of £10 per person. This refund will be limited to the amount of money paid to the organiser/s (less £10 per person)and will not include any costs or expenses incurred elsewhere.

6.6 The Organiser will refund the relevant amount within 28 days of cancellation.

  1. Amendments

7.1 If a Participant or Participating Team is unable to participate in the event due to unforeseen circumstances, the place may be transferred to another person providing they meet the eligibility criteria in clause 3 above.

7.2 It may be necessary to make changes to the itinerary of the event due to unforeseen circumstances beyond our control.

7.3 We reserve the right to cancel the event if there are insufficient numbers to make it commercially viable. In this case all registered teams will be notified and a full refund will be issued minus the £10 per person administration fee. We are not liable for any other costs you may incur other than payments made to Cornwall Banger Rally Challenge.

7.4 To avoid cancellation of any given event, alternative cost reductions will be investigated first.

7.5 Registered teams will be notified of any major changes by e-mail to their Team Captain.

  1. Insurance

8.1 Participants and Participating Teams must ensure that they possess comprehensive car insurance for all drivers for the entire duration of the event.

8.2 The Organiser/s strongly recommends that Participants and Participating Teams carry registration documents of the car at all times during the event.

8.43 The Organiser/s further recommends the purchase of personal travel insurance and breakdown insurance.

  • Prizes

11.1 The Organiser/s will award trophies to the Participating Team for –

11.1.1 Accumulating the most number of points from the completion of daily challenges/quizzes during the course of the event, and

11.1.2 Accumulating the second and third most number of points from the completion of daily challenges/quizzes during the course of the Cornball Run and

11.1.3 Overall Rally winner

11.1.4 Second Runner Up

11.1.5 Third Runner Up

11.1.7 Spirit of the rally award

11.1.8 Best fancy dress (during the event)

  1. Miscellaneous

12.1 Participating Teams acknowledge that their driving and conduct will have an impact on the reputation of the Cornwall Banger Rally Challenge, on the Organiser/s, and on the Participating Team itself. The Organiser/s reserves the right to disqualify a Participant or member(s) of a Participating Team at any time without notice during the event, for behaviour that causes or is likely to cause danger, upset or distress to any third party or damage to property. Such disqualification will be treated as a cancellation and will be subject to a forfeiture of the Full Payment. The Organiser/s shall not be liable for any extra expenses incurred by the Participant or member of a Participating Team as a result of disqualification.

  1. Limitation of Liability

13.1 In all cases, the liability of the Organiser/s will be limited to the amount actually paid by the Participant or the Participating team to the Organiser/s.

13.2 The Organiser/s will not accept liability for events that are outside its control.

13.3 The Organiser/s will not be responsible or liable for ensuring that Participants of Participating Teams meet the eligibility criteria set out in Regulation 3. By accepting these terms and conditions, all Participants and Participating Teams confirm that they understand that it will be their sole responsibility to ensure that they hold a valid driver’s license, and all other eligibility criteria set out in Regulation 3 above.

13.4 The Organiser/s will not be liable for arranging insurances or any breakdown or other cover on behalf of the Participants or Participating Teams. Provision of compulsory insurance cover shall remain the sole liability of the Participants or Participating Teams.

13.5 The Organiser/s will not be liable for ensuring that Participants or Participating Teams are aware of driving regulations on the event. This shall remain the sole responsibility of the Participant or the drivers of a Participating Team.

13.6 The Organiser/s will not be liable should any Participant or Participating Team be refused entry/exit or passage within any area visited on route, and in particular the Organiser/s will not be liable for any additional expenses incurred as a result.

13.7 The Organiser/s will not be liable should any Participant or Participating Team be unable to complete the event due to breakdown or for some other reason, and in particular the Organiser/s will not be liable for any additional expenses incurred as a result.

13.8 Many of the services during the event are provided by independent third party suppliers (Such as Food and Accommodation if chosen) who provide such services on their own terms and conditions. The Organiser/s bears no responsibility for these terms and conditions and the Participants and Participating Teams acknowledge that they will avail of the services from independent third party suppliers without any liability to the Organiser/s.

13.9 It will be the sole responsibility of the Participants and Participating Teams to ensure that decorations to cars comply with legal requirements of uk Highway code.

 

13.10 By participating in the Cornball 24, you consent to be photographed and to be included in any filming documenting. You hereby waive any and all rights of publicity or privacy and grant the Organiser/s complete permission to utilise and exploit your appearance in the Cornball  24 in any and all manner and media inclusive or social media platforms. You further agree that the Organiser/s has/have the sole discretion to use or refuse, to use any photographs or footage in which you may appear, and that if the Organiser/s do/does use such photographs or footage, it may be edited at the Organiser’s sole discretion. You consent to the use of your name, image, voice and biographical material about you in connection with any and all footage, publicity and related promotional material, and for any and all publicity and promotional purposes. You expressly release the Organiser/s from and against any and all claims which you have or may have for invasion of privacy, defamation or any other cause of action arising out of the production, distribution, broadcast or exhibition of photographs, footage or any promotional materials.

13.11 The Participants and all members of a Participating Team acknowledge that they understand they may be exposed to a variety of risks, foreseen and unforeseen, which may or may not be inherent to the Cornball 24 and that these risks may include, but are not limited to, property damage or loss, serious personal injury, or death from exposure to the risks. Participants and Participating Teams will be personally responsible for all costs and/or risks associated with the Cornball 24 and the Organiser/s will not be liable in any way whatsoever for the same.

13.12 Notwithstanding anything to the contrary herein, to the fullest extent allowed by law, the Participant and Participating Teams agree to waive and discharge all claims, release the Organiser/s from all liability and indemnify and hold harmless the Organiser/s and other partners/employees from any and all liability on account of, or in any way resulting from, injuries and damages in any way connected with the Cornball 24. Participants and Participating Teams agree and understand that this assumption of risk and release is binding upon them, their heirs and executors.

  1. Governing law and jurisdiction

All disputes arising out of or in connection with these terms and conditions, or the contract between the Organiser/s or the Participants or Participating Team, shall be subject to English law and the jurisdiction of English courts.
